Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Envoca (“Envoca,” “we,” “us”). They govern your access to and use of the Envoca website, apps, and AI voice-agent service (the “Service”). By creating an account or using the Service, you agree to these Terms. If you’re using Envoca on behalf of a business, you’re agreeing on its behalf and confirming you’re authorized to do so.
1. The Service
Envoca provides an AI-powered virtual receptionist that can answer phone calls, respond to callers using the knowledge you provide, take messages, and help schedule appointments. The Service is provided on an “as-available” basis and may change as we add, improve, or retire features.
The agent is automated software. It can make mistakes, mishear, or give incomplete answers. You’re responsible for reviewing what it says on your behalf and for any actions taken based on its output.
2. Eligibility & your account
- You must be at least 18 and able to form a binding contract.
- You’re responsible for keeping your login credentials secure and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Tell us promptly at support if you suspect unauthorized use of your account.
3. Acceptable use
You agree not to use the Service to:
- Break the law, or violate telemarketing, robocall, call-recording, or consumer-protection rules (including the TCPA and applicable state laws).
- Place or enable unsolicited, deceptive, harassing, or high-volume automated calls.
- Impersonate others, or misrepresent that the agent is a human when asked.
- Handle emergency, medical, legal, or safety-critical calls that require a guaranteed human response.
- Upload unlawful content, infringe others’ rights, or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
You are solely responsible for obtaining any consents required to use an AI agent and to record or transcribe calls in your jurisdiction.
4. Phone numbers, calls & recordings
Numbers provisioned through the Service are provided via our telephony partners and remain subject to their terms and to carrier requirements. Porting a number is a regulated process and may be delayed or rejected by the losing carrier. Calls may be recorded, transcribed, and summarized to operate and improve the Service. You are responsible for any caller notice or consent the law requires.
5. Free minutes, plans & billing
- We may offer free trial minutes. Free allowances are for evaluation, may be limited, and can change or end at any time.
- Paid plans (when available) are billed in advance on a recurring basis until cancelled. Fees are non-refundable except where required by law.
- You authorize us and our payment processor to charge your payment method for the plan and usage you select.
- We may change pricing with reasonable notice; changes apply to the next billing cycle.
6. Your content & knowledge base
You retain ownership of the business information, knowledge base, greetings, and other content you provide (“Your Content”). You grant Envoca a worldwide, non-exclusive license to host, process, and use Your Content solely to operate, secure, and improve the Service for you. You represent that you have the rights to provide Your Content and that it doesn’t violate these Terms or anyone’s rights.
7. Third-party services
The Service relies on third parties, for example telephony, cloud hosting, AI model providers, and sign-in providers. Your use may be subject to their terms, and we aren’t responsible for third-party services we don’t control. See our Privacy Policy for how data is shared with them.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by Envoca and its licensors and is protected by law. Except for the rights expressly granted here, we reserve all rights. You may not copy, modify, distribute, or create derivative works from the Service.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that the agent’s responses will be accurate or complete. Envoca is not a substitute for emergency services, never rely on it for urgent or life-safety needs.
10. Limitation of liability
To the maximum extent permitted by law, Envoca and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the three months before the claim, or USD $100.
11. Indemnification
You agree to indemnify and hold Envoca harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law, including call-recording and telemarketing laws.
12. Suspension & termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law gives you the right to bring a claim elsewhere.
